1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Sites or Services. By using the Sites, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Sites on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.
The Sites are not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13, as detailed in the Privacy Policy below.
2. User Accounts and Registration
Certain features of the Sites may require you to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or suspected breach of security.
We reserve the right to suspend or terminate your account at any time, for any reason, including if we believe you have violated these Terms.
3. Donations and Purchases
The Sites may allow you to make donations or purchases, which are considered contributions to Torch QRF. All donations and purchases are final and non-refundable, except as required by applicable law or if they do not comply with Arizona campaign finance/election law and/or other federal or state regulations.
When making a donation, you must provide required information, including name, mailing address, amount, occupation (including type of work, employer, and principal place of business) for individuals, or business information (type of business and location) for non-individuals. If your cumulative contributions exceed $100, we are required to report this information to the Arizona Department of Elections.
Foreign corporations and foreign nationals without permanent resident status (i.e., without a valid green card) are prohibited from donating to Torch QRF. By making a donation, you represent and warrant that you are eligible under applicable federal and state laws.
Payment information, such as credit card details, is collected solely to process transactions and is handled in accordance with the Privacy Policy. We may use third-party payment processors, and your use of their services is subject to their terms and privacy policies.
4. User Content and Submissions
You may submit content, such as comments, messages, or other materials ("User Content"), to the Sites, including through forms, emails, social feeds, or interactive features. By submitting User Content, you grant Torch QRF a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, distribute, and display such User Content in connection with the Services.
You represent and warrant that your User Content does not violate any third-party rights, including intellectual property rights, and is not unlawful, defamatory, obscene, or harmful. We reserve the right to remove or edit User Content at our discretion but are not obligated to monitor it.
Submissions to social media platforms linked from the Sites are at your own risk, as detailed in the Privacy Policy.
5. Prohibited Conduct
You agree not to:

"Torch QRF" and related marks are trademarks of Torch QRF. You may not use them without prior written permission.

The Sites may contain links to third-party websites, services, or advertisements. We do not endorse or control these third parties and are not responsible for their content, privacy practices, or availability. Your interactions with them are at your own risk.
8. Disclaimers and Limitation of Liability
THE SITES AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, TORCH QRF, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITES OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS.
9. Indemnification
You agree to indemnify, defend, and hold harmless Torch QRF, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Sites, violation of these Terms, or infringement of third-party rights.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict of laws principles. Any disputes arising from these Terms or your use of the Sites shall be resolved exclusively in the state or federal courts located in Oklahoma County, Oklahoma. You waive any objection to venue or jurisdiction.

11. Miscellaneous

Severability: If any provision of these Terms is held invalid, the remainder shall continue in full force.

Privacy Policy
Overview
This Privacy Policy outlines our practices for collection, use, and disclosure of your information that you provide to us when you use our Site and other Torch QRF mobile applications that display this policy. By using these Sites, you agree that your use of the Sites is governed by this Privacy Policy and our Terms of Service. From time to time, we may update this Privacy Policy. We encourage you to periodically check this Site for updates. We will alert you to changes that have been made by indicating on the Policy the date it was last updated. Your continued use of the Site affirms your agreement to any changes we make to this Privacy Policy.
Information Collected and How it is Collected
Voluntary Information:
We may collect personal information that you voluntarily provide to us including your name, e-mail address, postal address, phone number, mobile number, and geographic location. You may provide this information when you request information, register, make a purchase, send us an email, sign up to receive email or text messages updates, connect through a social feed, fill out a form or for other purposes. We may also collect demographic information such as gender, date of birth, occupation, employer name and zip code. When this information is linked to personally identifiable information, it will be treated as voluntary personal information. In limited circumstances, we may collect payment information such as credit card number where needed to complete a requested service or transaction. Voluntary personal information does not include aggregate data (data about a group or category of users that has been stripped of identifiable information about individual users) that we may collect about the use of the Sites. This policy does not restrict our collection and use of such aggregate information.
By requesting information to your mobile phone, we may obtain the following information from you in connection with our SMS service: your cell phone number, your carrier’s name, and the date, time and content of your messages, as well as other information that you or your carrier provides. We will use such information in accordance with this Privacy Policy.
Automatically Generated Information:
We may also collect non-personally identifiable information that is generated automatically while you are visiting the Site or elsewhere on the Internet when our advertisements are served, also known as log files. This data includes, but is not limited to, information such as IP address, web pages visited before and after visiting the Site, date and time, domain type, type of mobile device you use, your device’s unique ID, web pages you view and links you click on within the Site and interactions with our advertisements delivered by us or advertisements delivered by a third-party advertising technology vendor. This website uses third party vendors such as Google to help analyze how users use the site. For example, Google Analytics uses cookies to collect standard Internet log information and visitor behavior information in an anonymous form. Torch QRF or our service providers or agents that provide services for us may use non-personally identifiable information as part of the Services to better tailor advertisements and other content in an effort to create a more relevant experience for each person that visits the Site or elsewhere on the Internet. Submitting your address anywhere on the Site may result in your e-mail address being added to Torch QRF’s e-mail list. Under California Law “the CCPA”, California residents have the right to request in writing from businesses with whom they have an established business relationship, (a) a list of the categories of personal information, such as name, e-mail and mailing address and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes and (b) the names and addresses of all such third parties. While, from our understanding, the CCPA does not currently apply to our use of collected data, a California user may nevertheless make an opt-out request by emailing info@torchqrf.org with “California Opt-Out” as the subject line. We will respond to such requests for information access or opt-outs within 45 days following receipt at the e-mail or mailing address stated above. If we receive your request at a different e-mail or mailing address or in the event of other extenuating circumstances, we will respond within a reasonable period of time, but not to exceed 135 days from the date received.
Your Nevada Privacy Rights
Under Nevada Law, Nevada residents may be entitled to opt-out of the sale of personal data collected on our site. As of the date of this policy, we do not knowingly engage in the “sale” of “personal information” of Nevada residents, based on our understanding of how the term “sale” is defined under Nevada law. Nevertheless, a Nevada resident may make an opt-out request by emailing info@torchqrf.org with “Nevada Opt-Out” as the subject line.
Children
We strongly encourage parents and guardians to regularly monitor and supervise their children’s online activities. We do not knowingly collect personal information from children under 13.
Donations
When you make a contribution to Torch QRF, Arizona law requires us to obtain the following information: name, mailing address, amount, occupation information (includes type of work, employer, and principal place of business) for individuals, and business information (type of business and location) for non-individual contributions. Arizona law requires us to report this information to the Arizona Department of Elections if your cumulative contributions exceed $100. Any credit card information provided is only used to immediately process your donation. All contributions made to the Site are considered final and non-refundable unless the donation is not in compliance with Arizona campaign finance/election law and/or other applicable federal or state campaign finance regulations. All purchases from the online store are considered contributions to Torch QRF and subject applicable federal and state laws regarding a donor’s eligibility to donate to Torch QRF. Foreign corporations and foreign nationals without permanent resident status are prohibited from donating to Torch QRF, unless the individual possesses a valid green card.
Visiting our Site from outside of the United States
If you are visiting our Site from outside of the United States of America, please be aware that your information may be transferred to, stored or processed in the United States, where our servers are located, and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country, but please be assured that we take steps to protect your privacy. By using our Site, you understand that your information may be transferred to our facilities and those third parties with whom we share it as described in this Privacy Policy.

Refund Policy
Use of the Torch QRF donations portal constitutes agreement to our terms of use. We encourage you to review the following information carefully.
REFUNDS & DONATIONS
Donations made to Torch QRF are non-refundable with limited exceptional circumstances outlined in the Conditions of Use. Refunds will only be permitted in the following specific circumstances:

The donation was made in error, had an incorrect amount, or the intended recipient was not that intended by the donor

The donation was not authorized by the donor
If you believe any donation made through this website or any affiliated online payment mechanism was done so without your knowledge or through fraudulent activity, you must inform Torch QRF within 15 days by sending the dispute and transaction details to info@torchqrf.org. If a refund is permitted the donor is responsible for contacting their tax advisor to determine if their tax return needs to be amended based on a charitable deduction no longer being valid.
PERSONAL INFORMATION
You may be required to provide personal information such as credit card information and billing information to an independent third party (“Processor”) that we choose in order to facilitate transactions on the Torch QRF donations portal. We may have multiple Processors for various services and products. The Processor is responsible for collecting, transmitting and processing your financial information. In some instances, we may choose a Processor to not only collect your financial information and process your order, but also to fulfill your donation. All payment obligations will be governed by the terms of use and privacy policies of the Processor. You are responsible for any data breach of your personal financial information or any problems related to the processing of your transaction. We make no warranties and accept no liability for any loss or damages in connection with the Processor(s). Torch QRF does not store any credit card or debit card information without permission.
WAIVER OF LIABILITY
By using the Torch QRF donations portal, you agree to assume the risks related to use. With the exception of liability to gross negligence or reckless and/or intentional conduct, you agree to release Torch QRF, and their respective officers, directors, employees, and consultants from the liability arising from use of the Torch QRF donations portal.
APPLICABLE LAW
By donating to Torch QRF you agree that the laws of the state of Oklahoma, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Torch QRF.
